This Privacy Policy (“Policy”) describes the privacy practices of Circular Genomics, Inc. and its subsidiaries (“Circular Genomics”, “we”, “us” or “our”), including but not limited to, those applicable to our research, services, the website maintained by Circular Genomics at www.circulargenomics.com (“Website”), and any other websites, platforms or apps maintained by Circular Genomics (collectively, the “Services”). This Policy does not apply to Circular Genomics’s clinical trials, including our mental health research registry, and the term “Services” should not be interpreted to refer to any such clinical trial(s).

‍Protecting the privacy and security of your personal information is important to Circular Genomics. This Policy is designed to help you understand what data Circular Genomics may collect and how Circular Genomics uses, discloses, and safeguards that data. We may change this Policy at any time by updating it on our Website. The revised version will be effective when it is posted. If we materially change the ways in which we use or disclose personal information previously collected from you through the Services, we will notify you through the Website, by email, or other communication.

Personal Information We Collect

When you use the Services, Circular Genomics may collect the personal information you provide us, including personal information you may provide us in order to access specific information.  When you submit your information through the Services, we may ask you for your name and email address.  If you are interested in one of our clinical trials, you will be asked to sign an Informed Consent and provide certain additional information. We do not use your personal information to assess your eligibility for a clinical trial unless and until we first obtain approval through an Informed Consent.

In addition to the above, as you use the Services, certain passive information may also be collected, including internet protocol addresses, cookies, navigational data, the name of the domain and host from which you access the Internet, the browser software you use and your operating system, the date and time you access the Services, and the Internet address of the website from which you linked directly to the Services.

We may also collect personal information if we conduct or sponsor surveys, business or marketing events, when you apply for employment or consulting roles and when you contact us via e-mail for information or assistance. In these instances, we may ask you for your name, email address, phone number, state of residence and/or mailing address.

We and our third-party partners collect information using cookies, pixel tags, or similar technologies. Our third-party partners, such as analytics and advertising partners, may use these technologies to collect information about your online activities over time and across different services. Cookies are small text files containing a string of alphanumeric characters. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to our Services. ‍Circular Genomics may also use Google Analytics or other analytics services to collect and process information regarding visitor behaviour and visitor demographics on our Services and to develop the Services. ‍We work with third-party advertising partners to show you ads that we think may interest you. Circular Genomics is based in the United States of America (US). The Website is directed towards users who reside in the US. Circular Genomics is committed to protecting the security of your personal information and we have implemented security measures to protect your personal information from loss, misuse, and unauthorised access, disclosure, alteration, or destruction. While we have implemented security measures, please keep in mind that perfect security does not exist and no storage or transmission of information is guaranteed to be completely secure. If you decide that you do not want your personal information used for the purposes described in this Policy, you may contact us (see the Contact Us section below) to request removal of your personal information from our database. You may also “opt-out” of receiving e-mails and other communications from us by using the unsubscribe feature that may be included in the e-mails we send or by contacting us.  Even if you opt out of receiving promotional messages from us, you may continue to receive administrative messages from us.

The www.circulargenomics.com website (the “Site”) is owned and operated by Circular Genomics, Inc., a Delaware corporation (together with its successors and assigns, “Circular Genomics”, “we”, “us” or “our”). The Site, together with any of our related sites, mobile applications or software tools, are collectively referred to herein as the “Services”. DISCLAIMER

Circular Genomics does not guarantee continuous, uninterrupted access to the Services, and operation of the Services may be interfered with by numerous factors outside of our control. When you access the Services through a mobile device, your wireless service carrier’s standard charges, data rates and other fees may apply, and Circular Genomics shall have no liability whatsoever for such charges, rates or other fees.

THE SITE AND OTHER SERVICES ARE PROVIDED BY CIRCULAR GENOMICS ON AN “AS IS” and “AS AVAILABLE” BASIS. CIRCULAR GENOMICS ASSUMES NO RESPONSIBILITY FOR THE TIMELINESS, DELETION, MIS-DELIVERY OR FAILURE TO STORE ANY CONTENT OR COMMUNICATIONS ON OR THROUGH THE SERVICES. PRIVACY

Circular Genomics agrees to treat your private personally identifiable information in accordance with the terms of our then current privacy policy, which is incorporated herein for all purposes, and which is available for review at www.circulargenomics.com/privacy.

GENERAL INFORMATION

These Terms constitute the entire agreement between each user and Circular Genomics and govern each user’s use of the Services, superseding any prior agreements. The Terms and the relationship between each user and Circular Genomics shall be governed by the laws of the State of New Mexico without regard to its conflict of law provisions, and each party shall submit to the personal and exclusive jurisdiction of the courts located within Bernalillo County, New Mexico. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect. Nothing herein shall be deemed to create an agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship of any kind between Circular Genomics and any user.

SURVIVAL

The provisions above listed under the headings “COPYRIGHT”, “APPLICABLE LAWS”, “LINKS TO/FROM OTHER WEBSITES”, “TERMINATION”, “INDEMNIFICATION” “DISCLAIMER”, “SUBMISSIONS”, “TRADEMARKS” and “GENERAL INFORMATION” shall survive any termination or expiration of these Terms with respect to any user.
